During our preliminary approval process, our attorneys review the information you have provided to ascertain if you are a candidate for a loan modification with your lender. The majority of our clients can expect to see positive results from the loan modification process once you are approved to enter our program. However unusual circumstances do arise. In these rare instances, we agree to provide a 100% money back guarantee in the unlikely event we cannot obtain a modification of your loan.
MAC agrees either to refund 100% of monies received by Client within 10 business days after receipt of a written request for refund by Client, or to revise modification proposal package to meet lender's additional requirements and/or negotiate modification request as needed, provided ALL of the following conditions have been met:
- We are unable to obtain either an offer of modification or an offer of refinance from your lender. An offer of modification or refinance will include one or more of the following on either the first or the second mortgage: (1) temporary or permanent reduction of interest rate; (2) extension of term of the mortgage loan; (3) reduction of monthly payments; (4) restructuring/recapitalizing arrearages to bring loan to a current status, or (5) an offer by the existing lender to refinance into a new loan.
- A foreclosure notice had not been recorded as of the day you returned to us (1) a signed Working Agreement (2) completed and signed disclosure documents, and (3) payment in full of our fee.
- You fulfilled your obligations and/or document request in a timely manner under the terms of our Working Agreement.
- All information (financial and otherwise) given to us by you is true and correct.
- The information you have submitted to MAC and/or circumstances you provided to MAC has not materially changed from the date of application.
In the event we are not completely confident that we can obtain positive results for you but you still want us to proceed on your behalf, this 100% Guarantee Policy may be amended or cancelled in its entirety. This would always be done in writing and will be spelled out in your specific Working Agreement.
